Punjab and Haryana HC takes suo moto notice of Nodeep Kaur’s harrassment


CHANDIGARH: Punjab and Haryana High Court has taken suo moto notice of the custodial harrassment of labout rights activists Nodeep Kaur lodged in Karnal jail in Haryana.

The court has issued notice to Haryana government to file a reply by February 24. The family of Nodeep Kaur has alleged that she was tortured and sexually assaulted in the police custody.

The court of Justice Arun Kumar Tyagi said that complaints of illegal custody of Nodeep Kaur were received on Feb 6 and 8 and on orders of Justice Jaswant Singh these complaints are trated as criminal writ petitions.

Nodeep Kaur was arrested on January 12 by Haryana police when she was protesting against the new central farm laws at Singhu border.

The emails received by High Court has alleged that Nodeep Kaur was kept in illegal confinement and a judicial probe was demanded into her arrest and harrassment. The email stated that this case is no more related to farmer protest but to respect of a woman who is tortured in jail cell. Another mail said, “Does law allows rape/assault/beat the person”.

The case of Nodeep Kaur has attracted international attention when Meena Harris niece of US Vice President Kamala Harris tweeted seeking release of Nodeep Kaur and raising voice against her sexual assault in police custody”.

Nodeep Kaur is a native of Mukatsar Sahib in Punjab. She was arrested in case related to FIR registered under sections 148(rioting), 149 (unlawful assembly), 323 (voluntaraly causing hurt, 452(tresspassing), 384 (extortion), and 506(criminal intimadidation) of the IPC. The complaint against Nodeep Kaur was made by a Kundli based industry.

Punjab State Women Commisiion has also taken suo moto notice of the Nodeep Kaur and sought a detailed report from SP Sonepat. Manisha Gulati chairman of Punjab women commission will meet Nodeep Kaur in Karnal jail on February 15.
